1. Responsibility for Equipment
From the moment the equipment leaves our premises (or is delivered to the hirer) until it is returned and accepted by us, the hirer is fully responsible for the equipment. This includes loss, theft, damage (however caused), and any associated costs.
2. Insurance Requirements
The hirer must, at their own expense, maintain insurance covering hired-in equipment for the full new-for-old replacement value of the equipment, including accessories and cases, for the entire hire period. The insurance must:
- Name the hirer as the insured party.
- Cover loss or damage from all risks, including theft from unattended vehicles, accidental damage, fire, flood, and malicious damage.
- Apply in all territories where the equipment will be used.
- Include cover whilst in transit.
The hirer must provide a valid insurance certificate or policy schedule before the hire commences. We reserve the right to verify cover with the hirer’s insurer. If adequate insurance is not provided, the hire will not proceed.
3. Primary Cover & Excess
The hirer’s insurance shall be the primary cover in the event of loss or damage. Any uninsured amounts, policy excesses, or rejected claims under the hirer’s policy remain the hirer’s sole responsibility and must be paid to us within 7 days of demand.
4. Security of Equipment
The hirer must take all reasonable steps to prevent loss or damage to the equipment, including but not limited to:
- Keeping equipment in locked premises or vehicles when unattended.
- Securing vehicles with alarms and immobilisers.
- Using robust transport cases provided.
- Not leaving equipment visible in vehicles.
5. Loss or Damage
In the event of loss or damage, the hirer must notify us immediately and follow any instructions given. The hirer must also notify their insurer without delay and cooperate fully in any claims process.
6. Continuing Hire Charges
Hire charges continue to apply until the equipment is repaired and returned to service or replaced, regardless of any insurance claim.
7. Indemnity
The hirer shall indemnify and hold harmless the owner against any loss, liability, claim, or expense arising from the hire of the equipment, including losses not covered by insurance.
